Empereon Constar Data Breach Investigation

Strauss Borrelli PLLC, a leading data breach law firm, is investigating Constar Financial Services, LLC, a part of Empereon Constar (“Constar”), regarding its recent data breach. The Constar data breach may have involved sensitive personal identifiable information belonging to over 8,500 individuals.

ABOUT EMPEREON CONSTAR:

Empereon Constar is a business process outsourcing company based in Arizona. Founded in 1997, Empereon Marketing acquired Constar Financial Services in 2010, forming Empereon Constar.4 Since then, services have been offered through these two distinct, but affiliated, privately held entities as Empereon Constar.5 Today, Empereon Constar’s full range of consumer and commercial services includes lead generation, inbound / outbound sales, account origination, customer care, customer service, technical support, first party collections, recovery collections, credit bureau dispute management, fraud risk management, anti-money laundering, loan servicing and loan processing.3 Headquartered in Phoenix, Arizona, Empereon Constar has over 10 locations across the United States and Mexico, and employs over 4,000 individuals.

WHAT HAPPENED?

Recently, Constar reported to the Attorney General of Maine that it had experienced a data breach in which the sensitive personal identifiable information in its systems may have been accessed. According to the breach notice, on July 22, 2024, Constar identified suspicious activity within the corporate computer environment of a partner company. As a result, the partner launched an investigation to determine the nature of the incident.

Through its investigation, the partner learned that files belonging to Constar in its systems may have been compromised by an unauthorized individual on or around June 30, 2024. As a result, Constar began a review of the data to determine what information had been impacted as well as identify the specific individuals affected. The exact type of personal information potentially exposed has not been made publicly available by Constar. However, according to state reporting guidelines, “personal information” can include the following types of information:

  • Name
  • Social Security number
  • Driver’s license or state identification card number
  • Account number, credit card number or debit card number, if circumstances exist wherein such a number could be used without additional identifying information, access codes or passwords
  • Account passwords or personal identification numbers or other access codes

 

In September 2024, Constar began mailing data breach notification letters to impacted individuals. Based on the breach notice sent to Maine residents, Constar is providing affected individuals with a list of the specific type of sensitive information impacted and complimentary credit monitoring services.
