Western New York Energy Data Breach Investigation

Strauss Borrelli PLLC, a leading data breach law firm, is investigating Western New York Energy, LLC (“WNYE”) regarding its recent data breach. The WNYE data breach may have involved sensitive personal information and protected health information belonging to an undetermined number of individuals.

ABOUT WESTERN NEW YORK ENERGY, LLC:

WNYE is a fuel producer based in New York focused on renewable energy resources. Founded in 2004, WNYE is the largest fuel ethanol producer in New York, making over 60 million gallons of ethanol each year.2 WNYE is also the largest purchaser of corn in New York, buying over 20 million bushels of corn annually and partnering with local farmers.2 Headquartered in Shelby, New York, WNYE employs over 60 individuals.

WHAT HAPPENED?

Recently, WNYE reported to the Attorney General of Vermont that it had experienced a data breach in which the sensitive personal identifiable information in its care may have been compromised. According to the breach notice, on or around April 25, 2025, WNYE detected a network security incident. 1 Following this discovery, WNYE launched an investigation to determine the nature of the incident.

Through its investigation, WNYE confirmed that sensitive personal information may have been accessed by an unauthorized third party. As a result, WNYE began a review of the data to determine what information had been impacted, as well as identify the specific individuals affected.1 While WNYE found no evidence that information has been specifically misused, the type of information potentially exposed includes:

  • Name
  • Social Security number

On June 4, 2025, WNYE began mailing data breach notification letters to impacted individuals. Based on the breach notice sent to Vermont residents, WNYE is providing affected individuals with a list of the specific types of sensitive information impacted and complementary credit monitoring services and proactive fraud assistance via Cyberscout. A link to the form breach notification that WNYE submitted to the Attorney General of Vermont is listed below.
