Strauss Borrelli PLLC, a leading data breach law firm, is investigating Bayhealth Medical Center (“Bayhealth”) regarding its recent cybersecurity incident. The Bayhealth cybersecurity incident may have involved sensitive personal information belonging to an undetermined number of individuals.

Bayhealth is a healthcare system headquartered in Dover, Delaware. As central and southern Delaware’s largest healthcare system, Bayhealth is comprised of Bayhealth Hospital – Kent Campus, Bayhealth Hospital – Sussex Campus, a freestanding Emergency Department in Smyrna, an Emergency and Urgent Care Center, Total Care in Milton, as well as numerous satellite facilities and employed physician practices encompassing a variety of specialties.2 Additionally, Bayhealth is an affiliate of Penn Medicine for Cardiac Surgery, Vascular Surgery, Orthopedics, and Neurosciences and is a member of the Penn Cancer Network.2 Bayhealth is a technologically advanced not-for-profit healthcare system with nearly 4,000 employees and a medical staff of more than 450 physicians and 200 advanced practice clinicians.2 In Fiscal Year 2023, Bayhealth recorded 107,911 emergency department visits, 18,022 patients admitted to beds, 2,545 births, and provided $37.61 million in unreimbursed care to patients.2
WHAT HAPPENED?
On August 1, 2024, Bayhealth disclosed a cybersecurity incident impacting the functionality of its systems. On August 3, 2024, Bayhealth posted an update on its Facebook page, stating: “On July 31, 2024, Bayhealth identified unusual activity on certain computer systems in the network. We promptly took proactive measures to contain the activity and implemented our incident response process – a cybersecurity firm was also engaged to assist. Further, out of an abundance of caution, we disabled all external connections to our network. Our Epic electronic health record continues to be in use as we safely care for our patients. The proactive measures we’ve taken means that we’re experiencing connection issues with MyChart.”1 As of August 8, 2024, Bayhealth has not disclosed the specific nature of the cyber security incident and whether the incident resulted in a data breach.
