The Phoenix Data Breach Investigation

Strauss Borrelli PLLC, a leading data breach law firm, is investigating Atlantis Operating LLC, which does business as The Phoenix Rehabilitation and Nursing Center (“The Phoenix”) regarding its recent data breach. The Phoenix data breach may have involved sensitive personal information and protected health information belonging to over 6,400 individuals.

The Phoenix is a healthcare facility in New York. Founded four decades ago, The Phoenix today serves those needing various forms of rehabilitation and care, including physical therapy, speech therapy, diabetic management, pain management, dental services, respite care, and more.2 Specialty programs that The Phoenix offers include orthopedic and general short-term rehabilitation, long term care, wound care, amputee care, dialysis services, recreation, and urban zen.3 Additionally, The Phoenix offers a free transportation service from select point in Brooklyn and Manhattan.3 Located in the Fort Greene section of Brooklyn, New York, The Phoenix has 400 beds and is a part of the CareRite Centers network.3

WHAT HAPPENED?

Recently, The Phoenix released a notice to the press stating that the sensitive personal identifiable information and protected health information in its care may have been compromised. According to the press release, on or about September 19, 2024, The Phoenix learned of a data security incident involving a third party vender.1 As a result, The Phoenix launched an investigation to determine the nature of the incident.

Through its investigation, The Phoenix confirmed that sensitive personal information of current or past patients may have been compromised by an unauthorized third party on or around July 20, 2024. As a result, The Phoenix began a review of the data to determine what information had been impacted as well as identify the specific individuals affected. While the information impacted varies depending on the individual, the type of information potentially exposed includes:

  • Name
  • Social Security number
  • Medical information
  • Address

 

On January 28, 2024, The Phoenix began mailing data breach notification letters to impacted individuals. Based on the press release, The Phoenix is providing affected individuals with a list of the information impacted. A link to The Phoenix’s press release is below.
