D.P. Nicoli Data Breach Investigation

Strauss Borrelli PLLC, a leading data breach law firm, is investigating D.P. Nicoli, Inc., regarding its recent data breach. The D.P. Nicoli data breach may have involved sensitive personal identifiable information belonging to an undetermined number of individuals.

ABOUT D.P. NICOLI, INC.:

D.P. Nicoli is a construction products company based in Oregon. Founded in 1982, D.P. Nicoli started primarily as a piling distributor and plate rental company.2 Later, D.P. Nicoli would add shoring and slide rail products, which would establish it as one of the only one-stop resources for the shoring needs of the heavy construction industry in the United States.2 Today, D.P. Nicoli’s products include steel plates, trench and manhole shields, slide rails, hydraulic shoring, build-a-box and aluminum shields, and pipe plugs. Headquartered in Wilsonville, Oregon, D.P. Nicoli has eight additional locations across California, Idaho, and Washington, and employs over 50 individuals.

WHAT HAPPENED?

Recently, D.P. Nicoli reported to the Attorney General of Montana that it had experienced a data breach in which the sensitive personal identifiable information in its systems may have been accessed and acquired. According to the breach notice, on or around April 30, 2024, D.P. Nicoli became aware of suspicious activity within its computer environment. As a result, D.P. Nicoli launched an investigation to determine the nature of the incident.

Through its investigation, D.P. Nicoli confirmed that sensitive personal information in its systems may have been viewed and obtained by an unauthorized third-party between April 29 and April 30, 2024. As a result, D.P. Nicoli began a review of the data to determine what information had been impacted as well as identify the specific individuals affected. On September 5, 2024, D.P. Nicoli completed this review. The exact type of personal information potentially exposed has not been made publicly available by D.P. Nicoli. However, according to state reporting guidelines, “personal information” can include the following types of information:

  • Name
  • Social Security number
  • Driver’s license or state-issued identification number
  • Financial account number, or credit or debit card number, with or without any required security code, access code, personal identification number or password, that would permit access to a resident’s financial account

As a result of the data breach, D.P. Nicoli began mailing data breach notification letters to impacted individuals. Based on the breach notice mailed to Montana residents, D.P. Nicoli is providing affected individuals with a list of the specific types of sensitive information impacted and 12 months of complimentary credit monitoring.
