Aviben Data Breach Investigation

Strauss Borrelli PLLC, a leading data breach law firm, is investigating Educators Benefit Consultants, LLC, which does business as Aviben, regarding its recent data breach. The Aviben data breach involved sensitive personal information belonging to over 39,000 individuals.

ABOUT EDUCATORS BENEFIT CONSULTANTS, LLC D/B/A AVIBEN:

Aviben is a third party administrator and benefit consulting company based in Minnesota.3 Founded in 2005, Aviben specializes in public sector benefit plans and currently provides one or more services in 91% of school districts in Minnesota.3 Additionally, Aviben does significant public and private sector work in several other states, including Arizona, California, Florida, Iowa, Indiana, Kansas, Michigan, North Dakota, and Wisconsin.3 Some of the benefit plans that Aviben helps design, implement, and manage include HRAs, HSAs 403(b)/457(b)/401(a), 125 FLEX, COBRAs, and more.4 Headquartered in Cambridge, Minnesota, Aviben employs over 10 individuals.

WHAT HAPPENED?

Recently, Aviben reported to the Attorney General of California that it had experienced a data breach in which the sensitive personal identifiable information in its systems may have been accessed. According to the breach notice, on February 22, 2024, Aviben became aware of a data security incident in which an unauthorized third party attempted to infiltrate its computer network. As a result, Aviben launched an investigation to determine the nature of the incident.

Through its investigation, Aviben learned that sensitive personal information in its systems may have been exposed on February 21, 2024. As a result, Aviben began a review of the data to determine what information had been impacted as well as identify the specific individuals affected. On July 11, 2024, Aviben concluded this review. While the information impacted varies depending on the individual, the type of information potentially exposed includes:               

  • Name
  • Social Security number
  • Date of birth
  • Driver’s license number
  • Passport number
  • Military ID number
  • Financial account number

 

On August 6, 2024, Aviben mailed data breach notification letters to impacted individuals. Based on the breach notice sent to California residents, Aviben is providing affected individuals with a list of the specific type of sensitive information impacted and 12 months of complimentary credit monitoring services.
